Foreclosure Attorney in Stockbridge, GA
Protecting Stockbridge Homeowners from Foreclosure Since 2007
When a foreclosure notice arrives, the window to act is short. Georgia’s nonjudicial foreclosure process can move from a written notice to a courthouse auction in as little as 30 days, and once the sale happens, there’s no coming back. At The Bankruptcy Law Group LLC, we’ve been helping homeowners throughout the Metro-Atlanta area, including Stockbridge, navigate exactly this situation since 2007. We handle foreclosure defense and bankruptcy under one roof. The same team that can halt a pending sale can also build a long-term recovery plan around your specific circumstances.
We offer free initial consultations, emergency legal services for urgent situations, and 24/7 phone availability. If you’ve just received a Notice of Intent to Foreclose, don’t wait.
Call The Bankruptcy Law Group LLC now at (770) 766-5004 to schedule your free consultation. Emergency legal services are available for homeowners facing an immediate foreclosure deadline.
How Georgia’s Foreclosure Process Works in Henry County
Georgia is a nonjudicial foreclosure state, which means lenders can foreclose using the power-of-sale clause in your security deed without ever obtaining a court judgment. Federal law generally requires lenders to wait until you’re at least 120 days delinquent before starting formal proceedings, but once they begin, the timeline compresses quickly.
The Notice & Advertising Requirements
Under O.C.G.A. § 44-14-162.2, your lender must send a written Notice of Intent to Foreclose by certified mail at least 30 days before the scheduled sale. They must also advertise the sale in the county’s official legal newspaper once per week for four consecutive weeks. In Henry County, foreclosure sales are held at the county courthouse on the first Tuesday of each month.
No Post-Sale Redemption Right in Georgia
Georgia doesn’t provide a statutory right of post-sale redemption after a nonjudicial foreclosure. Once your home is sold at auction, you can’t reclaim it by paying the debt. The period before the sale is the only window in which intervention may be available. That’s why acting immediately after receiving a notice matters so much.
Using Bankruptcy to Stop a Foreclosure Sale
Filing for bankruptcy triggers an automatic stay, which is a federal injunction that immediately halts all collection activity, including a scheduled foreclosure sale. The stay takes effect the moment the petition is filed, so if your auction date is approaching, filing before it begins can stop the sale from proceeding.
The two chapters most relevant to homeowners are Chapter 13 and Chapter 7. Chapter 13 bankruptcy allows you to keep your home by catching up on missed mortgage payments through a structured repayment plan lasting three to five years. It’s often the stronger option when preserving the property is the goal. Chapter 7 can provide temporary relief but doesn’t include a mechanism to cure mortgage arrears, so it’s better suited to other situations. Our attorneys review each client’s circumstances to determine which approach, or which combination of strategies, fits their goals.
Foreclosure Defense Strategies Beyond Bankruptcy
Bankruptcy isn’t the only tool available. Depending on your situation, we may pursue other approaches alongside or instead of a bankruptcy filing.
Options we evaluate for Stockbridge clients include:
- Loan modification: Negotiating adjusted mortgage terms, such as an interest-rate reduction or an extended loan term, to make monthly payments more manageable
- Forbearance: A temporary agreement with your lender to pause or reduce payments, typically with a repayment arrangement later
- Short sale: Selling the property for less than the outstanding balance with lender approval, which may help avoid a foreclosure on your credit record
- Deed in lieu of foreclosure: Voluntarily transferring ownership to the lender when other paths aren’t viable
- Procedural challenges: Lender errors or defects in the notice process may provide grounds to challenge or delay a foreclosure under Georgia law
We work with each client to assess which combination of loss mitigation strategies gives them the most realistic path forward.

Building a Recovery Plan Around Your Whole Financial Picture
A foreclosure rarely happens in isolation. Job loss, medical debt, divorce, and unexpected income disruption are among the most common causes of mortgage default, and stopping the foreclosure is only part of the work. Our team reviews your income, debts, and financial goals before recommending any strategy, then builds a tailored recovery plan that addresses both the immediate threat and the underlying debt load.
The goal isn’t just to get past the auction date. It’s to give you a realistic path to long-term financial stability. We work to make that process as clear and low-stress as possible, even when the circumstances feel overwhelming.

"I felt like a weight was lifted from my shoulders and I could start over again with rebuilding my credit."This was my very first time filing for bankruptcy and was afraid b/c of the stories that I had heard of in not being able to get credit for ten years. After surfing the web, I contacted Attorney Stacey Lynn Butler. After explain my situation to her staff, they scheduled me an appointment right away. Attorney Stacey Lynn Butler and her staff were very friendly, caring, knowledgeable, responsive, and trustworthy. I was pleased to know that I could have my attorney fees deducted from my paycheck weekly instead of paying the entire fee upfront. They stopped the already in progress garnishment and got ALL of the money returned to me! After gathering all of the requested documents, I was given a court date. After the court date, I received a letter from the judge approving my bankruptcy. I felt like a weight was lifted from my shoulders and I could start over again with rebuilding my credit. I would like to say to Attorney Stacey Lynn Butler and Staff....Thank you so much for a job well done!- Timothy

"I have and will continue to recommend this Law Group to my family, friends and co-workers. I know they will be in grand hands."n these days and times, with so much negativity in the world, it is rare that we take the time to show appreciation to those who improve, enhance, help, encourage and go above and beyond in their choice of occupation. Today, I am writing to each of you to say THANK YOU. From the very first phone call to inquire about bankruptcy, to the timely updates on my case, filing my case so quickly and meeting with me to explain in detail how the process works, to the representation at the 1st meeting to confirmation, I have been impressed and awed beyond measure. I was extremely hesitant about filing for bankruptcy but from day, but no one judged nor admonished me. Instead, I was given a positive response for taking responsibility to take care of my debt and worked diligently to choose my best option. From that day, every one was timely, professional and caring. All calls were answered or a return call by the very next morning (even weekends), email responses within what seem instantaneously and always with care and concern. Ms. Stacey and her entire staff (in my case - Lionel, Ms. Tracie, and Ronald) are WONDERFUL !!! Thank you. Thank you. Thank you. I have and will continue to recommend this Law Group to my family, friends and co-workers. I know they will be in grand hands.- Anonymous

"Its a relief to see the light at the end of the tunnel and start my life over with better savings and credit score."i had previously filed a chapter 13 with another attorney needless to say it got dismissed without me knowing. I found out it was dismissed from a mailer i received in the mail from THE BANKRUPTCY LAW GROUP LLC . The person that answered the phone was LIONEL he is amazing at what he does. He told me everything i needed to do even called when one of my payment didn't go through to update payment. The entire team is amazing TINA MARIE PERRY is amazing she reminded me to make my court payments and to take my last class. I totally would have had to start all over again if it wasn't for her friendly email and phone call reminders. I filed for bankruptcy in April yesterday 7/3/17. I received an alert that it was dismissed. Although Im not done yet. Its a relief to see the light at the end of the tunnel and start my life over with better savings and credit score. THANK YOU SO MUCH FOR EVERYTHING- Tameka Thomas
