Eligibility for Chapter 13 Bankruptcy in Macon

Effective July 1, 2026, Georgia’s homestead exemption protects up to $50,000 of a debtor’s aggregate interest in a residence. The amount is up to $100,000 when both spouses use the property as their primary residence and title is held by the debtor spouse.

Georgia’s wildcard exemption protects up to $1,200 in value, plus as much as $10,000 of any unused homestead exemption. It can apply to property that doesn’t fit within another exemption category. Ownership, equity, liens, and filing circumstances all affect how these protections apply.

Credit Report Duration:
Chapter 13 remains on a credit report for seven years. That reporting period should be weighed alongside the debt, payment pressure, property concerns, and available alternatives.
